Home Builders Association of Virginia | Last Updated July 2, 20261. Acceptance of Terms
By accessing or using the website located at hbav.com (the “Site”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, please do not use the Site. These Terms apply to all visitors, users, and others who access the Site.
The Home Builders Association of Virginia (“HBAV,” “we,” “us,” or “our”) reserves the right to modify these Terms at any time. Continued use of the Site after any such changes constitutes your acceptance of the revised Terms.
2. Use of the Site
Permitted Use
You may use the Site for lawful purposes and in accordance with these Terms. You agree to use the Site only to access information about HBAV, its programs, advocacy activities, events, and affiliated entities including the HBAV Education Foundation and BuildPAC, and to make lawful donations or inquiries.
Prohibited Use
You agree not to:
- Use the Site in any way that violates applicable federal, state, or local law or regulation
- Use the Site to transmit unsolicited commercial email or other communications
- Attempt to gain unauthorized access to any portion of the Site or its related systems
- Use any automated tools, bots, scrapers, or data-mining techniques to extract content from the Site without our written permission
- Upload or transmit viruses, malware, or other harmful code
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Engage in any conduct that restricts or inhibits any other person’s use or enjoyment of the Site
3. Intellectual Property
All content on the Site — including but not limited to text, graphics, logos, photographs, audio clips, and software — is the property of HBAV or its content suppliers and is protected by applicable copyright, trademark, and other intellectual property laws.
You may view, download, and print content from the Site for your personal, non-commercial use only, provided that you:
- Do not modify or alter the content
- Retain all copyright and proprietary notices
- Do not represent the content as your own
Any other use of Site content — including reproduction, modification, distribution, transmission, republication, or display for commercial purposes — requires the prior written consent of HBAV.
The HBAV name, logo, and all related marks are trademarks of the Home Builders Association of Virginia. Nothing on this Site grants any license to use HBAV’s trademarks without prior written permission.
4. Online Donations
General Donations and Education Foundation Gifts
HBAV accepts online donations through its secure giving platform. Donations to HBAV programs and to the HBAV Education Foundation, a 501(c)(3) nonprofit organization, are processed in accordance with our Privacy Policy and the terms of our payment processor. Gifts to the HBAV Education Foundation may be tax-deductible to the extent permitted by law. HBAV does not provide legal or tax advice; please consult your tax advisor regarding the deductibility of your contribution.
BuildPAC Contributions
Contributions to HBAV BuildPAC are voluntary political contributions to Virginia’s home building industry political action committee and are not tax-deductible. By making a contribution to BuildPAC, you represent that:
- You are a United States citizen or lawfully admitted permanent resident alien
- You are making this contribution with your own personal funds, not funds provided by another person for the purpose of making this contribution
- You are not a federal contractor
- You are making this contribution on a voluntary basis
BuildPAC contributions are subject to applicable federal and state campaign finance laws. Contributor information including name, address, employer, and occupation is required by law and will be publicly disclosed in regulatory filings.
Refund Policy
All donations are final. HBAV does not provide refunds on charitable donations or political contributions. If you believe a transaction was made in error, please contact us promptly at [email protected] and we will review the matter on a case-by-case basis.
5. Third-Party Services and Links
The Site may contain links to third-party websites, resources, and services including local Home Builders Association chapters, the National Association of Home Builders (NAHB), event platforms, and other industry resources. These links are provided for your convenience only. HBAV does not endorse, control, or assume responsibility for the content, privacy practices, or availability of any third-party sites. Your use of third-party sites is at your own risk and subject to their respective terms and policies.
Certain features of the Site, including member registration and event management, may be powered by GrowthZone, a third-party association management platform. Use of those features is subject to GrowthZone’s applicable terms of service in addition to these Terms.
6. Disclaimer of Warranties
THE SITE AND ALL CONTENT, INFORMATION, AND SERVICES PROVIDED THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. HBAV DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
HBAV does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components, or that defects will be corrected. HBAV makes no warranty regarding the accuracy, completeness, or timeliness of any content on the Site.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HBAV AND ITS OFFICERS, DIRECTORS, EMPLOYEES, MEMBERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF HBAV HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
HBAV’s total liability to you for any claim arising out of or related to these Terms or your use of the Site shall not exceed the greater of (a) the amount you paid to HBAV in the twelve months preceding the claim or (b) one hundred dollars ($100).
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.
8. Indemnification
You agree to indemnify, defend, and hold harmless HBAV and its officers, directors, employees, members, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
9. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Site shall be resolved in the state or federal courts located in Richmond, Virginia, and you consent to the personal jurisdiction of such courts.
10. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.
11. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and HBAV regarding your use of the Site and supersede any prior agreements or understandings on that subject.
